Most of you reading this will undoubtedly use Google as a search engine, at least once in a while. There may be a major choice(even though statistics suggest that is), but we can use it regularly in any event. But it can not be. Can use the Microsoft search engine Bing. Especially if your privacy.
Privacy in the network and the right to it has long been a topic for discussion. Basically, each time for Internet ventures someone, somewhere is tracking to some extent, either in the form of cookies or other data tracking techniques.
This week has been a debate about privacy on the Web to move to class. Facebook has rolled out its new privacy controls, , which are currently designed so that more public places. It is no coincidence that Google recently rolled out their new Live Search Results , of which updates Facebook will soon be part of it.
Then came Google CEO Eric Schmidt interview with CNBC on the protection of privacy on the Web. It was Eric Schmidt, CEO of Google, saying exactly what he thinks about your privacy. There is no doubt, not taken out of context here. Heres how you can easily switch from Firefoxs Google search Bing.(Yes, Bing is better than Googles privacy policy.)
He links to Bing enlargement to Firefox search engine that changes in the upper part of Googles browser window(by default) to Bing. Mozilla is not clearly friend from Microsoft, designed to Firefox as an alternative to Internet Explorer. Given that I always had a close relationship with Google and generates most of its revenue from search giant. Relations sour little after Google launched Chrome, and I can not see doing anything to heal the rift.

If you are in the process of settling a lawsuit where the value of your case is based upon the merits of your testimony it is important to realize the opposing party will do anything to discredit you. Alternatively, if you are selling a structured settlement annuity a best interest finding will determine whether you will receive a lump sum of cash or not. There have been changes to the legal landscape you need to be aware of in order to protect your best interest. Before the web and social media, researching a plaintiff, witness, employee or spouse required hiring a private investigator to dig up dirt on the person. Maybe they would follow them around taking photographs with telescopic lens catching them in compromising positions. Investigators would find other witnesses to undermine their credibility. Nowadays lawyers, investigators, insurance companies, spouses, employers and even the Federal Government are using the Internet, specifically social media, to gather intelligence with a simple mouse click.

Just about everyone uses the web and almost as many are involved in some aspect of social media. Whether it is a site like Facebook or community like Meet Up they are broadcasting their whereabouts, opinions and other details of their lives in a public forum. Even if they are cautious enough to use the privacy settings they may have befriended someone they know little or nothing about.

Some data can easily be found by using a search engine or two. Other data is obtained due to the exploitation of people’s narcissistic tendency to have more friends. According to a study by the advocacy group Electronic Frontier Foundation (EFF), law enforcement agencies of all types as well as the Internal Revenue Service are gathering information from these sites. The EFF obtained a 38 page training document detailing how to conduct these searches and refine the results.[1] The U.S. Citizenship and Immigration Services (USCIS) investigators become friends with petitioners to determine whether or not their application data is fraudulent.[2] In addition, the FBI has developed a tool called Writeprint that claims to help identify the creators of anonymous online content.[3]

According to a Wisconsin Law Journal post, lawyers are using information from social media to discredit potential witnesses as well as investigate their clients. While some of the information is out in the open for anyone to find using a search engine, some agents for attorneys have admitted to becoming friends with the opposition in order to obtain information they wouldn’t have access to otherwise. Some lawyers have admitted to reviewing client posts and rejecting them.[4] Dan Nabel of The Legal Intelligencer states in the article called, “When Can Attorneys Advise Clients to Change Online Privacy Settings?” that in some cases lawyers have been able to obtain court orders to gain access to private and deleted social media pages to be used as evidence in a variety of cases including personal injury lawsuits, workers compensation and wrongful termination cases.

If this wasn’t proof enough that you need to be careful about your posts, employers[5] as well as insurance[6] companies are using social media to gain access to information that they wouldn’t have access to otherwise. In some instances, it could set the stage for discriminatory practices as well as lawsuits.[7] It could also affect the insured’s ability to collect payments on insurance claims.

As social media continues to evolve and new technologies are introduced, user privacy or lack thereof will continue to be an issue. The information that is gathered and how it is used as well as integrity of this data are things that need to be considered. In the future, hopefully, there will be more protection for social media users and their privacy. Until then the best course of action is to refrain from posting anything you don’t want everyone to know about you or used against you in the future especially if and when your personal injury lawsuit goes to trial.

Most employees just accept the fact that their employer can access any content that is on a company computer, including employees’ personal emails and other personal information. But, is that the law? A growing number of courts are recognizing that employees have some expectation of privacy with respect to their personal content on company computers. Some recent decisions have held that employers do not own and cannot access their employees’ personal emails not even when those emails were sent on a company computer.

Marina Stengart v. Loving Care Agency, Inc. is a workplace privacy case that was decided on June 26, 2009. Marina Stengart worked as an Executive Director of Nursing at Loving Care Agency, Inc. Loving Care provided Stengart with a company computer and an email address to accomplish her work duties. Loving Care had an electronic communications policy which stated that emails, internet use and computer files are considered the company’s property and “are not to be considered private or personal to any individual employee.” The policy also stated that the company had “the right to review, audit, intercept, access, and disclose all matters on the company’s media systems and services at any time, with or without notice.”

Stengart used her company computer to email her attorneys about filing a discrimination lawsuit against Loving Care. But, Stengart did not use her company email address. She emailed her attorneys with her personal, password protected Yahoo email account while using her company computer. Stengart resigned from her employment and sued Loving Care for discrimination. Loving Care then searched Stengart’s company computer and, pursuant to its electronic communications policy, read the emails Stengart exchanged with her attorneys. Stengart angered by Loving Care’s reading of her personal emails, asked the Court to decide if Loving Care had the right under its electronic communications policy to read emails she sent to her attorneys through her personal email account on her company computer.

The Stengart Court rejected the notion that an employee’s personal emails become company property simply because the company owns the computer, claiming that a company computer in this setting is little more than a file cabinet: “Property rights are no less offended when an employer examines documents stored on a computer as when an employer rifles through a folder containing an employee’s private papers or reaches in and examines the contents of an employee’s pockets; indeed, even when a legitimate business purpose could support such a search, we can envision no valid precept of property law that would convert the employer’s interest in determining what is in those locations with a right to own the contents of the employee’s folder of private papers or the contents of his pocket.” The Court ruled against Loving Care, concluding that an employer cannot “transform all private communications into company property — merely because the company owned the computer used to make the private communications or used to access such private information during work hours.”

Marina Stengart asked the Court if her employer had the right to view her personal emails. Bonnie Van Alstyne took the workplace privacy notion a step further when she sued her former employer for accessing her personal emails. Bonnie Van Alstyne worked as a Vice President at Electronic Scriptorium Limited, a small data conversion company owned and operated by Edward Leonard. Van Alstyne had a company email account, but she occasionally used her personal AOL email account to conduct business. Van Alstyne’s employment was terminated and she filed a sexual harassment lawsuit against the company. During the discovery process, Van Alstyne learned that Edward Leonard accessed her personal email account both during and after her employment. Leonard produced 258 emails he had printed from Van Alstyne’s personal email account.

Van Alstyne filed a separate lawsuit against Leonard, Bonnie Van Alstyne v. Electronic Scriptorium Limited, et al. Her lawsuit alleged that Leonard violated the Stored Communications Act when he accessed her personal email account and viewed her emails. The Stored Communications Act creates criminal and civil liability for any individual who “intentionally accesses without authorization a facility through which an electronic communication service is provided” or “intentionally exceeds an authorization to access that facility” and “obtains, alters, or prevents authorized access to a wire or electronic communication while it is in electronic storage in such system.” In other words, the Stored Communication Act prohibits an individual from, among other things, intentionally accessing other people’s stored emails, voicemails, text messages, etc. without permission. A jury found that Leonard violated the Stored Communications Act and awarded Van Alstyne $250,000 in compensatory and punitive damages and more than $136,000 in attorneys fees and costs.

The law is changing. Courts are recognizing that employees have a right to privacy in their personal emails even when those emails are sent on company computers and even when company policy says otherwise. But, both Marina Stengart’s and Bonnie Van Alstyne’s employers read their personal emails which gave their employers valuable defensive information and severely prejudiced Stengart and Van Alstyne in their pending lawsuits. A lawsuit cannot unring that bell. And, Stengart and Van Alstyne were forced into lengthy, costly legal battles to enforce their privacy rights. It is encouraging that courts are recognizing employee privacy rights and giving employees remedies when those rights are violated. However, the best course of action is to keep your personal email and your company computer separate thereby eliminating any possibility that your employer will view your personal emails.

With The Foundation for Information Policy Research [F.I.P.R] (a leading campaigner on the protection of digital rights), and Sir Tim Berners-Lee (the founder of the World Wide Web) warning about threats to our online privacy what does the future of internet look like for the average user?

Firstly we need to consider what the threats are and why they have come to the fore. The Internet, in its conception, offers all of us an unprecedented opportunity for freedom of expression. What’s more, it presents a tantalizing opportunity for us to wrestle the control of mass media away from the traditional brokers of power. In essence it means that we no longer need to suffer the indignity of being force fed the “official view”. The Internet truly is democracy in action.

Now I think we all acknowledge that most of us use the Internet either as a means of communication or a source of entertainment. It will therefore come as no surprise to anyone that statistics (according to Alexa.com) reveal the sites that receive the largest number of visitors (excluding the major search engines) are either social networking, file sharing or porn sites. Whilst this does not perhaps reflect well upon the “Internet for a greater good theory” it does at least demonstrate that the Internet is a user led system which truly reflects the whole sphere of human interest (however base it may be).

However the same statistics also reveal that the top 100 most visited sites (again excluding the search engines) still account for only a small proportion of total Internet traffic. The Internet is vast and diverse, there is a wealth of information out there and a healthy degree of skepticism is required for nearly all of it. Nonetheless the potential for a genuine liberty of ideas remains.
For that reason it is with a sense of foreboding that I note the recent observations of both Sir Berners-Lee and the FIPR. Far from offering liberty for all the Internet has actually become the biggest threat to our individual privacy since the advent of the printing press. Unfortunately this seems to be, in no small part, due to our own carelessness. The information that we post on sites such as Facebook, Youtube and, for that matter, this one is not only viewable by practically anybody else but will also remain in perpetuity (unless we remember to remove it of course).
It is easy to see that a little more discretion is required by those of us who wish to maintain our privacy. This seems a fairly simple step to take to preserve our security but unfortunately it may not be enough. Not only do our governments tend to lose massive amounts of our personal data but there is also a far more pervasive threat to our personal liberty.

The market research company “Phorm”have recently been in negotiation with three of the U K’s biggest internet service providers (BT, Virgin Media and Talk Talk) and, it seems, contracts have been agreed. Phorm, amongst others, possesses the technology to scrutinize any individuals surfing habits and can provide advertisers the data they require to provide “personalized advertising”. There has been some debate about whether this should be an ‘opt in’ or ‘opt out’ element of your internet service provision but, either way, we are all going to have to inspect our service agreements very carefully.

For its part, Phorm (already a multinational corporation) insists that it does not keep internet “clicktrails” permanently and offers an internet security service by warning users when they are about to enter details on ‘phishing’ sites. Despite these claims Facebook has already used statistics gathered this way within it’s much criticized ‘Beacon’ system and the projected annual revenue generated by BT, should they use Phorm’s services, has been estimated at over £80 million ($160 million). So it seems unlikely that objections will be heeded.

Of more concern perhaps is the possibility of misuse of the same technology. For example it would enable insurance companies to increase the premiums of customers who frequently check HIV prevention sites; governments could monitor the online activities of anybody they felt were ‘undesirable’ without court jurisdiction; banks could refuse credit for ‘unwise spending’. This is not to mention the criminal potential.

So whatever the future holds it seems inevitable that the days of surfing the net without the need to consider protecting our privacy along the way are already gone.

I read an article two years ago claiming that in the year 2010 there will be two kinds of business: those who have an Internet presence, and those who are going out of business. Although I did not agree with that assertion – and we now can see that it was not true – I absolutely agree with its implication; we saw the atomic-like explosion of Internet popularity in ‘Web 1.0′ (that is, before the dot-com bubble burst wide open), and the continued exponential growth of the Internet currently in ‘Web 2.0-3.0′. Never has it been easier to own an Internet presence. Less than ten bucks for a domain name, a nominal monthly hosting plan, and a (free) website, and you’re there! According to “Internet World Stats” (www.Internetworldstats.com/stats.htm), out of the 6.6 billion people in the world (in 2007), more than 1.3 billion are using the Internet. North America has the highest penetration of the population, at over 75%! Wow! In North America, over 75% of the population uses the Internet! Although Asia accounts for more than 56% of the total world’s population, the 2007 Internet penetration estimate is less than 14% (which is still a larger number of Internet users than North America: North America 238 million versus Asia with 510 million). These are some fascinating and staggering figures, even though they are now dated, making them even more significant. I can only imagine what this year’s estimates will be. As any Internet user knows, there are millions upon millions of online businesses (legitimates and not). You name it and you can find it online! In the future, there will surely still be physical, ‘brick-and-mortar’ businesses in the world that are not on the Internet – absolutely – but it is evident that the bulk of the world’s economy will eventually be the Internet, or whatever digital backbone follows it.

But we all know that the Internet is gravely dangerous in so many ways. It has often been called the modern day equivalent of the wild west of old. Yes, the digital age has brought us so many luxuries and conveniences, but it has also ushered in new venues for the “decomposers of the world” to operate, make huge money, and victimize people. There are millions of brilliant, cunning, clever, viscously shrewd “sharks” in the vast ocean of the digital ethers. There is spyware that exposes some scammer data in your personal system. Yet seemingly nothing can stop the countless money scams and schemes, hackers, and elaborate con-artists robbing business of valuable customer data, and individuals of their money and identity. We have tons of chat rooms where people hide in the shadows watching for their prey, child pornographers, and so much more! One cannot begin to describe the “invisible” pitfalls of the Internet.

So how do we protect our businesses, our homes, our children, and ourselves in the digital age? This question is continually debated, and debated, and debated some more. In the interim, there is little change. Collectively, people are not willing to trade some measure of privacy for the desired security of personalization. Even so, it is my belief that in the arena of e-security, cyber terrorism, and other Internet crimes, we patrons of the Internet are reactive instead of proactive in the fight to thwart the shrewd e-beasts, e-terrorists, and e-criminals. The time has come to implement drastic changes, regulations, and therefore proactive protections.

So finally I get to the point. My IDEA is this: an “E-Pol Network”. Yes, I am speaking about an Internet Police Network! The idea has three parts: 1) funding the E-Pol Network, 2) the structure and composition of the E-Pol Network, and 3) the challenges that must be overcome from inside and outside the network. By the way, my assumption is that the US would take the lead in this endeavor as a model for other countries.

Part One: First I must talk about funding the E-Pol Network; otherwise the idea has no feasibility. The only way I can see to “police” (for lack of a better term) the Internet is through an “e-tax”. We must convince all Internet businesses that it is in their best interest to support the E-Pol Network by paying a small tax, based upon their gross revenue. This pool of money funds the E-Pol Network, and is perhaps supported by some federal and/or state funds as well. Certainly there are intrinsic challenges with the funding piece of the idea (see Part 3 below). Perhaps State and Federal funds can be allocated as well.

Part Two: What exactly is an E-Pol Network? It is a network of e-pol (or e-police) “pods” that oversee and investigate Internet usage within their respective region, according to an umbrella of policies and procedures that governs the entire network. So, imagine that each state is divided on an imaginary map into regions, according to population. Each region would have one e-pol pod ‘to protect and serve’ that e-community. One e-pol pod is simply one office of Internet police that are watching a region. Obviously, then, each e-pol pod is part of the E-Pol Network. The “umbrella policy” would set forth the mission, the goals or mandates, and the overall procedures by which the network operates and would evolve as the system grows. The central mission of the E-Pol Network is to proactively “catch” the worst of e-crimes and e-criminals that make the Internet so dangerous. The E-Pol Network would work in conjunction with the State and local police departments, the Criminal Justice System as a whole, and the international police as well. This basic concept has already been shown to be effective in catching some sexual predators who use the Internet as their playground, but it must be expanded to include all forms of e-crime. Again, there are challenges to overcome with this piece (see Part 3 below).

Part Three: What are some of the challenges and problems with the concept of the E-Pol Network? Perhaps at the top of the list is privacy. We are all concerned with the Orwellian idea that ‘Big Brother’ is watching, invading our personal freedoms or rights. Even though inherently within the E-Pol Network there must be some degree of privacy invasion, my belief is that the benefits outweigh the risks. Then too, if you have nothing to hide, you have no worries, except that the E-Pol Network itself might become corrupted. Which brings me to the point of E-Pol Network integrity. An oversight committee might have to be mandated. My hope is that there is a way to build and maintain the honesty of the E-Pol Network. Further, there is the matter of the e-tax funding, its parameters, and its distribution, etc. Heck, I’ll leave that one to the experts and my readers. And of course there is the issue of the policies and guidelines of the E-Pol Network. As I have stated, the central mission is fighting online criminals and crimes. Beyond that, let’s discuss it! There are a host of challenges that would come with this conceptual territory.

This idea is intended as the footings of the foundation of a structure built to protect us from the online universe. I do not claim that it is the answer to all related matters, nor do I profess to know or fully comprehend those issues. I do know that something tangible must be done now to kill the outrageous virus of e-crime and cyber terrorism.
